Terms of Service

These Terms of Service ("Terms") govern your use of the MyCal AI mobile application (the "App") and the mycalai.co website, which are developed and operated by Tharun Tech Solutions (https://tharuntechsolutions.in/), a software studio based in India ("MyCal AI", "we", "us", "our"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use MyCal AI. By using the App, you represent that you meet this requirement and that you can form a binding contract with us.

2. Not Medical Advice

MyCal AI provides AI-generated estimates of calories and nutrition, and general educational information through the AI Nutrition Coach and Menu Scan features. This is not medical advice, and MyCal AI is not a substitute for professional medical, nutritional, or dietary consultation. Nutrition estimates from photos are approximations and may be inaccurate. Always consult a qualified healthcare provider for medical or dietary decisions, especially if you have a health condition.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

4. Subscriptions and Billing

• MyCal AI offers a free tier with limited daily AI scans, and optional Premium subscriptions (Weekly, Monthly, or Yearly) with higher daily limits.
• Subscriptions are billed and processed through Google Play Billing and renew automatically until cancelled.
• You can cancel anytime through your Google Play account settings; cancellation takes effect at the end of the current billing period.
• Refunds are handled according to Google Play's refund policies, not directly by us.
• Some subscriptions may include a free trial period; unless cancelled before the trial ends, you will be charged at the end of the trial.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to circumvent usage limits, quotas, or Play Integrity checks.
• Reverse engineer, decompile, or attempt to extract the App's source code or AI prompts.
• Upload content that is illegal, abusive, or infringes on others' rights.
• Use automated means (bots, scripts) to access the App's backend services.

6. Your Content

You retain ownership of the photos and content you submit. By submitting a photo for analysis, you grant us a limited license to process it (including via third-party AI providers) solely to provide the App's features to you.

7. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that AI-generated nutrition estimates are accurate, complete, or error-free. We do not warrant that the App will be uninterrupted or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, MyCal AI and its developers will not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to reliance on nutrition estimates or AI Coach responses.

9. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and request account deletion at any time.

10. Changes to These Terms

We may update these Terms from time to time. We will update the "Effective" date above when changes are made. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles.
